These Terms of Service ("Terms") govern your use of CarBack ("the App"), developed by Digital Gemba, LLC ("we," "us," or "our"). By downloading or using the App, you agree to these Terms.
CarBack pairs with a Garmin Varia rear-view radar to provide voice alerts when vehicles approach from behind. It is designed as a supplementary awareness tool for cyclists. You may use the App for personal, non-commercial purposes in accordance with these Terms and applicable laws.
The App does not require any account creation or login. All data is stored locally on your device.
All data you enter into the App (preferences, paired device information) is stored locally on your device. We do not have access to your data. Deleting the app permanently removes all stored data.
CarBack is a supplementary awareness tool. It is not a substitute for your mirror, head-checks, Garmin head unit display, or safe riding practices. Do not rely on CarBack as your primary source of traffic awareness.
Radar alerts depend on Bluetooth connectivity, radar detection accuracy, and environmental factors. Alerts may be missed, delayed, or fail silently. Distance announcements reflect data from the Varia radar and may not be perfectly accurate. The alert feature is in a test phase and may change or be removed in future updates.
You are solely responsible for your safety and the safety of others while riding. Always ride as if CarBack is not running.

The App, including its design, features, and code, is owned by Digital Gemba, LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We make no warranty regarding the accuracy, reliability, or timeliness of radar alerts.
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to physical injury, equipment damage, or other losses resulting from:
We reserve the right to modify, suspend, or discontinue the App at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the App after any changes constitutes acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
